Attorney’s affidavit

What is an affidavit in Israel?

An affidavit is a written statement of facts made by the person signing it (the declarant). It may be submitted in legal proceedings or used in other situations where a formal declaration is required. The Israeli Judicial Authority describes an affidavit as a written document that can serve as testimony or support a claim outside court. See the official guidance on filing an affidavit.

Is an affidavit the same as a power of attorney?

No. An affidavit states facts; a power of attorney authorizes another person to act on someone’s behalf. The two documents serve different purposes and should not be described interchangeably.

How is an affidavit signed?

The required form and verification depend on the purpose of the document. In many cases, the declarant signs before a lawyer who verifies the identity and signature and gives the required warning about truthfulness. The Israeli government explains an online identity-verification process for affidavits. Check the requirements of the body receiving the document before signing.

This information is general and does not replace legal advice about a specific affidavit.

When should you seek help with an affidavit?

Requirements depend on where the affidavit will be submitted. Identify the receiving authority and any required form or supporting documents before signing. Do not sign a statement you cannot confirm is accurate.

An affidavit is not automatically a notarized document. If notarization is required, ask about that separately. Contact Paz & Co. Law Office to discuss your document.
