Activating a Continuing Power of Attorney in Israel: A Family Checklist

Signing an Israeli continuing power of attorney is not the same as bringing it into effect. Even after deposit, the conditions in the document must be checked and the activation procedure completed with the Administrator General. This distinction matters when a family needs to act for someone whose condition has changed.

Deposit and activation: what is the difference?

They are separate stages. Activation requires a document whose deposit has been approved and an assessment that its activation conditions have been met. As a general rule, the relevant stage is when the person can no longer understand the matter covered by the document.

What should be checked before activation?

Read the activation conditions in the document. The representative submits a declaration to the Administrator General, together with a medical opinion or another document required by the specified condition. Check who must be notified, including the person who made the document and people named in it. The procedure results in approval or another response; do not assume signing alone authorizes action.

A preparation checklist for the family

  • Locate the deposited document and confirmation of deposit.
  • List the appointed representatives and substitutes.
  • Identify the activation clause and the matters covered.
  • Prepare questions about current needs: care, accounts, living arrangements or property.
  • Decide who will coordinate paperwork and family communication, without assuming that this person has authority to make every decision.

What should be checked after activation?

Actions must fit the powers and instructions in the document. Before a significant decision, check whether it is authorized and whether further review is needed. Keep an organized file with the approved document, contact details and records of communication with relevant institutions.

Frequently asked questions

Does a medical diagnosis alone activate the document?

Do not rely on a diagnosis alone. Check the condition in the document and complete the appropriate activation procedure.

What if family members disagree?

Start by examining what the document says, who has authority and for which matters. Seek advice on the circumstances before acting, rather than relying on assumptions about a relative’s powers.
