Parents Helping to Buy an Apartment: Gift, Loan and Prenup
Parents giving money towards a young couple’s apartment? The difference between a gift to one spouse, a gift to both and a loan, and how a prenup protects it.
In every area of law, civil, criminal or otherwise, certain documents are relevant. An affidavit signed and authenticated by a lawyer is one of the most important of them. It serves as written testimony by the person who signs it and is equivalent to oral testimony in court.
An affidavit is written testimony in which the declarant confirms things they saw or did. By signing the document drafted by the lawyer, the declarant affirms that their statements are true. Making a false affidavit is prohibited, and the declarant may be summoned to court and cross-examined on it. The lawyer must warn the declarant that they are liable to penalties if they do not tell the truth, and must draft the affidavit as accurately as possible.
Affidavits may be authenticated by lawyers, notaries, persons authorised by the Minister of Justice, judges, religious court judges and heads of local authorities. Affidavits are needed for many purposes, for example municipal tax, the courts, the Execution Office, parking permits, the Ministry of the Interior or the Ministry of Defence. Our office is available to prepare and authenticate affidavits.
Please bring your ID card or passport so that we can identify you and return a signed and authenticated affidavit. Meetings can be arranged at our offices in Tel Aviv, Jerusalem and Modi’in. Contact us.
