Parents Helping to Buy an Apartment: Gift, Loan and Prenup
Parents giving money towards a young couple’s apartment? The difference between a gift to one spouse, a gift to both and a loan, and how a prenup protects it.
Before approving a draft or entering into a significant obligation, it is worth understanding exactly what each party undertakes to do, when and how. A contract lawyer can review existing wording, find unclear clauses, draft changes and conduct negotiations. A review does not guarantee there will be no dispute, but it can reduce risks and misunderstandings.
Check the identity of the parties, the scope of the service or transaction, the price, payment and performance dates, each party’s liability, the possibility of changes and cancellation, and how breaches or disputes will be handled. Appendices, quotes and promises made during negotiations should also be properly reflected in the draft if the parties wish to rely on them.
Not every contract requires the same review: a sale agreement, a services agreement and an agreement between partners raise different questions. See also drafting legal agreements.
A contract lawyer helps you understand the obligations and risks in a draft, proposes precise wording and checks whether the terms match the purpose of the engagement. Under Israel’s Contracts (General Part) Law, a contractual engagement is not just a matter of the document’s title; the offer, acceptance and circumstances must be examined. It is therefore important to check drafts and messages sent to the other side even before signing.
Ask who will handle the matter, whether they have dealt with this type of transaction before, what the draft review includes, how negotiations will be conducted, and what the fees and timetable are. General experience is no substitute for understanding your transaction, and no lawyer can guarantee that the other side will meet its obligations.
Gather the draft, appendices, quotes and important correspondence, and mark clauses you do not understand or that do not match what was agreed. Paz Israel & Co. helps review and draft agreements. Contact us to discuss your case.
