Before Registering a Trademark: How to Check the Name, Logo and Classification

A trade name or logo can be a significant business asset. Before filing a trademark application, stop and consider three questions: what exactly you want to protect, whether similar marks exist, and for which goods or services registration is sought. An early check does not guarantee approval, but it helps file an accurate application and understand the risks.

Should you file the business name, the logo or both?

A trademark can include words, letters, numbers or a design. The choice between a word mark and a figurative mark depends on how the business uses the brand and the purpose of protection. If the logo may change but the name will stay, that matters when choosing what to file. Where several elements are important, consider whether separate applications are needed and what each choice costs.

Why search before filing?

A search aims to find registered marks and pending applications that may be similar. The official Israeli trademark database is an important starting point. However, similarity is not judged only by identical words: there may be questions of similarity in sound, appearance, meaning and field of activity. A search with no exact match is not, in itself, confirmation that the mark is free to use or register.

What is the classification of goods and services, and why does it matter?

An application relates to the goods or services the mark identifies. Choosing the right classes and wording is important, and a wrong choice can harm the application. There is no point choosing a broad description unrelated to your actual activity just to “cover everything”.

Does filing an application mean the mark is registered?

No. After filing, the application is checked for formal requirements and then examined for registrability. Clarifications or amendments may be requested. It is important to distinguish between an application filed, a mark under examination and a mark actually registered.

What to prepare for a meeting with a lawyer

Bring the name or logo, a simple description of the products and services, where the business operates or plans to operate, and any similar marks you have found. Paz Israel & Co. supports business owners in checking marks and in registration proceedings in Israel.
