What is the difference between a continuing power of attorney and a will?
An Israeli continuing power of attorney lets an adult decide in advance who will handle their affairs and how if they can no longer understand and make decisions about the matters covered. A will addresses distribution of the estate after death. The documents serve different purposes; one does not necessarily replace the other.
When does the continuing power of attorney take effect?
It does not take effect automatically on signing. After approved deposit, activation follows the conditions in the document and the Administrator General’s procedure. See our activation guide and the official procedure (Hebrew).
How does it differ from appointing a guardian?
With a continuing power of attorney, the person selects representatives and instructions in advance while able to understand the decision. A guardian is appointed through legal proceedings when the applicable conditions are met. Suitability depends on individual circumstances; do not assume a continuing power of attorney removes every oversight or approval requirement.
Must the representative be a relative?
Not necessarily. Choose a suitable person who agrees to the role and meets legal requirements. You can appoint one or more representatives and define their responsibilities. The Administrator General’s preparation and deposit guidance (Hebrew) provides further information.
Can the representative make a will for me?
A continuing power of attorney is not a substitute for a will and does not allow the representative to decide for you how your estate will be distributed. Anyone wishing to address distribution after death should consider a will separately.
Who should consider a continuing power of attorney?
An adult who understands the document and wishes to plan who will handle their affairs if they cannot do so in future can explore the option. The decision depends on circumstances, wishes and trust in the proposed representative. There is no single answer for everyone.
What should you discuss before preparation?
Discuss the powers, advance instructions, choice of representative and activation conditions. According to the Administrator General, preparation is before a suitably trained lawyer with no personal interest in the document, subject to exceptions described in the official service.
