When one partner owns an apartment before the relationship begins, the question is not only whose name it is registered in. During your life together there may be mortgage payments, renovations, letting, a move to another home and investment by both partners in the property. A tailored prenuptial agreement can settle in advance how you wish to treat these situations. The answer depends on the circumstances and the applicable law, so no single wording suits everyone.
What should you establish before drafting?
The starting point is an accurate picture of rights and obligations: when the apartment was bought, how the rights are registered, the outstanding mortgage, the sources of funding and payments made or expected. It is also important to know whether the apartment will be your shared home, let or sold. These facts help draft clear agreements rather than settling for a general sentence such as “the apartment will remain the property of the person who bought it”.
What if you pay the mortgage together or renovate the apartment?
Sharing expenses can create different expectations. The agreement can set out how payments towards the mortgage principal, renovation investments or other significant expenses will be documented, and what they will mean on separation. Do not assume that every payment necessarily creates ownership, nor that registration alone resolves every dispute. The wording should reflect the sources of the money and what was actually agreed.
What if the apartment is sold and another one bought?
A change of property over the years is one of the situations worth thinking about in advance. The agreement can address the sale proceeds, additional money put into a replacement home, registration of the new apartment and how the partners will settle accounts, reducing uncertainty even when the original property is no longer owned.
Does the prenup need to be approved?
The appropriate approval or authentication route depends on when the agreement is made and the couple’s status. For an agreement between married spouses, and an application for court approval, it is important that the terms are understood and approved as required. Court approval gives the agreement the force of a judgment, but it does not mean that no dispute or legal claim can ever arise. See also how a prenup is approved in Israel.
Who can benefit from legal support?
The issue is particularly relevant where there is an existing apartment, an active mortgage, investment by both partners, children from a previous relationship or a plan to buy a replacement property. A prenup lawyer can map the facts, propose wording that addresses practical scenarios and check the right approval route. Paz Israel & Co. helps couples prepare personal, clear agreements.
