In a pinui-binui (evacuation and reconstruction) project, apartment owners must leave their homes and wait for a new apartment. The question of which guarantees and securities will be available to them is therefore not a minor detail of the agreement. The types of security, their amount, the conditions for enforcing them and the stage at which they are delivered should be examined against the project documents and its risks before committing to vacate.
Why is it not enough for the agreement to say the developer “will provide guarantees”?
General wording does not answer practical questions: which obligation is secured, who issues the guarantee, what its amount is, when it is delivered, when it can be enforced and when it is returned. The mechanisms must also be coordinated with the payment schedule, financing and construction. Owners need a clear picture of the protections at each stage, not just a list of guarantee names.
Which risks may require different securities?
The agreement may address securing receipt of the new apartment, rent payments during the evacuation period, certain tax liabilities and completion of registration of rights. This does not mean every project requires exactly the same set of securities or amounts. The government guide to pinui-binui agreements (Hebrew) presents guarantee issues and conditions worth considering.
What should be checked before handing the apartment to the developer?
Before vacating, check which conditions must be met, which document or security is delivered to the owner, when alternative rent starts and what happens if construction is delayed. Also check who handles the move, whether there are solutions for owners with special needs and how updates will be provided during construction.
Who represents the owners’ interests?
The owners’ lawyer must examine the agreement and the securities from their point of view. Representation includes explaining the terms and risks, coordinating with suitable professionals and following up on the required documents.
Questions to raise before signing
Is the wording of the securities attached to the agreement? What happens if the developer or financing body does not meet its obligations? Is the rent adjusted for a period of delay? Who takes care of registering the new apartment? The answers depend on the specific project and should be examined together with all the transaction documents.
