Parents Helping to Buy an Apartment: Gift, Loan and Prenup
Parents giving money towards a young couple’s apartment? The difference between a gift to one spouse, a gift to both and a loan, and how a prenup protects it.
What exactly is a prenuptial agreement, and when do you need a prenup lawyer? A prenup is one of the most important financial agreements a couple can make. It sets out in a detailed and orderly way how money, property and assets will be divided if the couple separate, so that everything is settled and known in advance.
Why is a prenup so important? In effect, it is your insurance policy for a future without disputes and without long, exhausting and expensive proceedings. Prenups can be signed at any stage of a relationship, but are mostly signed before marriage. Some say they create mistrust between partners, but in our experience the opposite is true: a prenup brings a sense of calm and security, because the couple know in advance what will happen if they separate.
A prenup must be drafted in a legally sound way that covers both partners’ financial rights, and it must be clear, because unclear wording invites a different interpretation later. A lawyer specialising in contracts and family law can draft a robust agreement that will be very difficult to challenge. An agreement that looks to the future is relevant even if the couple have no property yet and simply want to agree in advance how a separation would be handled.
A prenup can be signed before or after the wedding, at any stage at which both partners feel ready. A prenup before marriage records each partner’s financial position before the marriage, so that if the couple separate, disputes are avoided. Everything is known and settled in advance.
Besides married couples, cohabiting partners can also have a lawyer draft a property agreement setting out each partner’s financial rights on separation. Because the Property Relations Law does not apply to cohabiting couples, they face greater uncertainty, so an agreement is especially important. We recommend drafting it with experienced lawyers, and you are welcome to an initial meeting at our office. Paz Israel & Co. has offices in Jerusalem, Modi’in, Tel Aviv and Ramat Gan, and provides support in drafting the agreement, signing it and having it approved by the court.
Want certainty about the future, in financial matters and beyond? Our team is available to guide you through the process. Contact us to arrange a meeting at one of our offices. Many couples tell us about the sense of calm they feel after signing their agreement.
