Real Estate Lawyer in Israel: What to Check Before a Property Transaction
Buying or selling a property in Israel involves more than agreeing on a price. Before signing, it is important to understand who holds the rights in the property, what is registered against it and which documents apply to the transaction. The checks required depend on the property and how its rights are recorded.
Why check the land registry extract?
An official land registry extract (known as a Tabu extract) can show registered owners, mortgages, liens, attachments, court orders and other restrictions. The Israeli Ministry of Justice recommends checking an extract before buying, selling or carrying out another legal transaction involving a property. The information reflects the registration on the date the extract is issued. Read the official land registry guidance and obtain an extract.
What if the property is not registered in the Land Registry?
Some property rights are managed through other bodies. The Israel Land Authority explains its property-information service and notes that a computer printout is not the same as a legally binding confirmation of rights. The appropriate documents and checks should be identified for the specific property.
How can legal advice help?
A real estate lawyer can review the relevant rights and transaction documents, explain legal risks and assist with the agreement and registration process. The scope of work depends on the circumstances; no single checklist replaces individual legal review.
