One of the first questions every business owner asks: “How soon will my mark be registered?” The answer depends on the examination queue at the Israel Patent Office, on the mark itself and on whether there are oppositions. Knowing the stages helps you plan.
The main stages
- Preliminary check: searching for similar marks and choosing classes. See checks before registering a trademark.
- Filing the application with the Trademarks Department of the Israel Patent Office, paying the fee according to the number of classes.
- Formal review of the details and documents.
- Substantive examination: the examiner checks whether the mark is registrable and whether it resembles existing marks. If there is a problem, an office action is issued.
- Acceptance and publication: an accepted mark is published, opening a three-month period for opposition.
- Registration: if no opposition is filed, or it is rejected, the mark is registered and a certificate issued.
How long in practice?
There is no fixed duration. A simple application with no office actions or opposition finishes sooner. A mark raising questions of similarity or distinctiveness, or facing an opposition, can take much longer. So file early, before launch.
Can it be expedited?
Yes, in some cases. You can request expedited examination, for example when there is a risk of infringement or an urgent commercial need. When approved, examination is carried out within a short time.
From when is the mark protected?
Registration is valid for ten years from the filing date and can be renewed. See trademark renewal and cancellation. Until registration, the application already sets priority against later filers, but full protection begins with registration.
